Kiyoru Terms of Service

1. The Service and License to Use

We grant you a personal, worldwide, revocable, non-transferable and non-exclusive license to access and use Kiyoru in order to catalogue your personal viewings (films, TV series, anime) and interact with the community.

• The source code, infrastructure, design, original artwork, logos and trademarks of Kiyoru remain our exclusive property.
• Reselling, copying, decompiling or attempting to extract the source code, or abusing the Kiyoru APIs (api.kiyoru.app), without our prior written authorization is prohibited.

2. Registration Requirements and Account Security

• Minimum age: To register you must be at least 14 years old (or the minimum age required by the law of your country to use independent online services).
• Authentication and Access: Access is provided through certified providers (e.g. Google, Apple). You are solely responsible for keeping your credentials confidential and for all activity carried out through your account.
• One account per person: Creating multiple accounts to circumvent suspensions, manipulate votes/polls or carry out spam practices is not allowed.

3. User-Generated Content (UGC) and License

What you write and share on Kiyoru (reviews, comments, lists, tier lists, ratings and profile images) remains your property.

• License to Kiyoru: By posting any content on Kiyoru, you grant us a worldwide, non-exclusive, royalty-free license to store, display, distribute, format and show that content within the platform for the ordinary purposes of the service.
• Visibility: Remember that the sections of your profile follow the permissions you set (Everyone, Followers, Friends, Only me). Comments in public community threads are visible to every user who has unlocked access to the related discussion.
• Imported data: By importing your history from other trackers (e.g. TV Time), you declare that you fully own that data. Kiyoru will use the uploaded file solely to populate your profile.
• Use of AI Assistance Tools and Voice Input
  • You acknowledge that the automatic translation, summarization and voice transcription features rely on probabilistic computational models: Kiyoru does not guarantee the absolute lexical or contextual accuracy of the translations or transcriptions generated.
  • Translation of Threads, Comments and Catalogue: community threads and user comments may be translated in real time by machine-learning models to ease multilingual dialogue. Kiyoru is not liable for inaccuracies, misunderstandings, mistranslations of slang or unintentionally offensive literal translations produced by the automatic models.
  • When you use assisted generation for reviews or viewing notes, you remain solely responsible for the final published content, which must in any case comply with our community guidelines and anti-spoiler rules.

4. Rules of Conduct and Anti-Spoiler Policy

Kiyoru is built on respect for other people’s passion. By using the platform you agree not to:

• Spread Intentional Spoilers: It is strictly forbidden to post previews and spoilers about plots or endings in fields visible to everyone (such as your profile name, bio or the title of public lists), or to circumvent the server-side technical protections of episode threads.
• Post Unlawful or Harmful Content: Hate speech, harassment, threats, defamation, pornography, explicit violence or content that exploits minors are prohibited.
• Inject scripts or malicious code: Any attempt at code injection (XSS), manipulation of security tokens, tampering with Firebase App Check tokens or abuse through bots is grounds for an immediate ban.
• Scrape or Deny Service: Mass scraping of the system APIs or of the proxies connected to the catalogue is not allowed.

5. Moderation, Profile Images and Sanctions

We apply a progressive moderation system to keep the community safe:

• Avatar Moderation: Uploaded avatars are subject to automated (Google Cloud Vision SafeSearch) and manual review. If an image is rejected, the system keeps its technical fingerprint (hash) to block re-uploads. You are entitled to a single appeal per contested image through the in-app system.
• Measures: In the event of a breach of the rules of conduct, Kiyoru reserves the unquestionable right to:
  1. Send a formal warning;
  2. Temporarily suspend the ability to comment, vote or interact for 1, 7 or 30 days;
  3. Disable or permanently ban the account in the event of serious or repeated violations.
• Audit and Transparency: Every relevant moderation action is tracked internally in the security logs together with its reason.

6. Copyright and Notices (DMCA / EU Law)

We respect the intellectual property of others. If you believe that content or an image uploaded by a user on Kiyoru infringes your copyright, send a reasoned notice to [email protected] specifying:

1. The copyrighted work you claim has been infringed;
2. The URL or the exact location within Kiyoru of the contested content;
3. Your contact details and a good-faith statement.

We will review the notice and promptly remove the infringing material.

7. External Catalogue Data

The descriptive metadata about films, TV series, anime and people (titles, synopses, plots, release dates, posters and cast credits) come from public or licensed databases and APIs, including The Movie Database (TMDB) and TheTVDB.

• The trademarks, copyrights and artwork of the works belong to their respective owners.
• This product uses the TMDB API but is not endorsed or certified by TMDB.
• Extracting, isolating or commercially repackaging catalogue data through our platform is prohibited.

8. Account Closure and Termination

• Closure by you: You can delete your account at any time from the app settings. Your personal data, history and photos will be removed as described in our Privacy Policy.
• Anonymization of comments: When the account is closed, comments posted in public threads are not deleted, in order to preserve the meaning of community discussions, but are permanently dissociated from your profile and converted into contributions by an anonymous author.
• Closure by us: We may revoke access or delete the account at any time in the event of non-compliance with these Terms or for legal reasons.

9. Disclaimer of Warranties and Limitation of Liability

• The Kiyoru service is provided in its current factual and legal state ("as is" and "as available"), without express or implied warranties of uninterrupted operation, absence of errors or fitness for a particular purpose.
• To the maximum extent permitted by applicable law, our total liability for any dispute or damage arising from the use of Kiyoru shall be limited to the total amount, if any, paid by the user to Kiyoru in the twelve (12) months preceding the harmful event.
• Nothing in these terms excludes or limits the mandatory consumer-protection rights provided by the law of your country of residence.

10. Changes to the Terms

We may periodically modify or update these Terms to reflect regulatory changes or the introduction of new features. In the event of substantial changes, we will inform you through an in-app notification before the new terms take effect. Continuing to use Kiyoru after the changes are published constitutes full acceptance of them.

11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with Italian law (or, subordinately, European Union law). If you use the service as a consumer residing in the European Union, you retain all mandatory protections and the jurisdiction established by the consumer-protection law of your country of residence.
